Terms of Service

1. Acceptance

By accessing or using QR Maker ("Service", "we", "us"), you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance.

2. Service Description

QR Maker provides QR code generation, dynamic short links, landing page publishing, scan analytics, and a REST API and MCP server for AI agents and developers. Features vary by plan.

3. Accounts

You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@qr-maker.io if you suspect unauthorised access.

4. Paid Plans & Billing

Paid subscriptions are billed in advance. Prices are shown on our Pricing page and may change with 30 days' notice. Payments are processed by Stripe — we do not store your card details.

You may cancel your subscription at any time via your account settings. Access continues until the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Distribute malware, phishing links, or fraudulent content
• Send unsolicited bulk communications (spam)
• Publish content that is illegal, hateful, or exploits minors
• Impersonate another person or entity
• Attempt to reverse-engineer, scrape, or overload the Service
• Violate any applicable law or regulation

We may suspend or terminate accounts that violate these rules without notice.

6. Content & Intellectual Property

Your content: You retain ownership of the content you submit (URLs, landing page text, images). You grant us a limited licence to store and process it solely to provide the Service.

Our platform: QR Maker's software, design, trademarks, and documentation are owned by us. You may not copy, modify, or distribute them without written permission.

QR Code trademark: "QR Code" is a registered trademark of DENSO WAVE INCORPORATED in the United States and other countries.

7. Data Protection

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. For users in the EU/EEA, we act as a data processor for QR scan data and as a data controller for account data, in compliance with the GDPR.

8. Service Availability

We aim for high availability but the Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access and may modify or discontinue features with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, QR Maker's total liability for any claim arising from these Terms or your use of the Service is limited to the greater of: (a) the amount you paid us in the 3 months preceding the claim, or (b) €100. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate the agreement at any time. We may suspend access immediately for violations of Section 5. Upon termination of a paid account, access continues until the end of the prepaid period. Your data is retained for 30 days after account closure, then deleted.

11. Governing Law

EU/EEA users: These Terms are governed by Spanish law. Disputes shall be submitted to the courts of Madrid, Spain.

All other users: These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved by binding arbitration under ICC rules.

Nothing prevents either party from seeking injunctive relief in any jurisdiction.
